Sandy Hansberry Needs Assistance - Issue with Driver

I was wondering if you could ask:
Have you ever had a situation, where a Company driver, was stopped for a DUI during personal time. The result is even though his driver's license is only suspended for 2 months, our insurance carrier told us he is uninsurable for the company for 3 years.
I guess my question is can we fight this and how to go about this?
If we don't do we offer him another job within the company?
Or should we just let him go?

Employees driving company vehicles were required to have a clean driving record. We checked their records regularly, they were required to report all violations immediately and my policy spelled that out. I would terminate employment. The optics of moving an employee to another position and keeping them employed when they committed a criminal offense was not an option for me.
Hi Sandy, I would consult an attorney before making a move. However, in this area, are there SOPs in place? Are there job descriptions and activities listed that they receive when hired and are expected to do? These typically fold into the SOPs as far as activities/process. Does this include the requirements for the job, i.e. drivers license, insurable, etc.? If so, and he no longer meets the requirements for the job, then that makes it easy.
